Code of Ethics Enforcement Process

REALTOR® Associations are responsible for enforcing the REALTOR® Code of Ethics. REALTORS® agree to adhere to the Code of Ethics when they join the local association. The Code of Ethics imposes duties that go beyond those required by law or regulation.

Difficulties that arise from a real estate transaction can be the result of a misunderstanding or miscommunication. The first step is to contact the Managing Broker/Owner of the real estate office to discuss the situation. Open, constructive discussion often resolves differences and can eliminate the need for further action.

REALTOR® members or the public may contact the local board to request the services of an OMBUDSMAN prior to filing an Ethics Complaint.

*Ethics Complaints cannot be used to collect reimbursements or damages.

More information is available through the Indiana Association of REALTORS® and National Association of REALTORS®.

To File an Ethics Complaint:

Contact the Elkhart County Board of REALTORS® at (574) 875-3283

The caller will be asked the following Questions:

  • Identify the name of the REALTOR®*
  • Description of the situation
  • Contact information

*This allows us to verify membership and continue with processing.

With your approval to move forward, this information will then be given to an Ombudsman who will then contact all parties involved to help reach a resolution.

If the Ombudsman is unable to help reach a resolution, an ethics complaint can still be filed. Filing fee $500.
